A PENHORA DO BEM DE FAMÍLIA DO FIADOR
Resumo
A intenção desta pesquisa é mostrar a diferença de tratamento que é dispensada ao locatário e ao fiador que se encontram numa mesma situação diante da inadimplência no pagamento de aluguéis vencidos em contrato de locação. Os referidos cidadãos são regidos pelo mesmo ordenamento jurídico, que tem no seu ápice a Constituição Federal, baseada em princípios pilares norteadores de todo o sistema normativo, dentre os quais se destacam o da igualdade e da dignidade da pessoa humana. A presente análise torna-se relevante, sobretuto, diante da tramitação na Câmara dos Deputados o Projeto de Lei 6413/09, do deputado Vicentinho Alves (PR-TO), que tem como escopo alterar o texto da Lei do Inquilinato, com a proibição da penhora do bem de família do fiador, o que fará, caso seja aprovado, valer o disposto no texto constitucional, que assegura proteção e concede direitos iguais a todos os cidadãos.
Abstract
The purpose of this paper is to show that a tenant and his co-signer receive different treatment when the former defaults on the rent payment. Despite being subjected to the same legislation, one which is based in the Federal Constitution which hold the principles of equality and dignity among men, these two parties are dealt differently by the law. Something ought to be done to stop the unfair different treatment of the two parties. Indeed, there is a law project (6413/09) written by Vicentinho Alves, a congressman for the state of Tocantins (PR-TO), which proposes changes to the real estate rent law disallowing the pawning of a surety’s property. If approved, the project will ensure the observance of the constitution, which bestow equal rights and protection to all citizens.
