O CUIDADE DE SI E A VELHICE: A CONTRIBUIÇÃO DE MICHEL FOUCAULT
Resumo
Este artigo analisa a questão do cuidado de si, que é amplamente desenvolvido na obra Hermenêutica do Sujeito de Michel Foucault (2006). O foco consiste em elucidar as características da prática do cuidado de si e qual seria o benefício gerado para o indivíduo, sempre a relacionando com a velhice. Compreendendo o conceito de cuidado de si, é possível relacionar a idéia de reivindicação de direitos e prerrogativas do idoso para que ele possa exercer plenamente o cuidado de si. De forma simples, o cuidado de si, para o idoso, só tem sentido e é possível quando este gozar de proteção jurídica, sendo-lhe garantidas as necessidades materiais, culturais, intelectuais e sociais básicas. Dessa forma, o cuidado de si, pensado em sua gênese como auto reflexão do sujeito e voltada à sua emancipação, se torna fundamento para a reivindicação de direitos, no caso deste trabalho, para os idosos, nas esferas pública e privada. O objetivo é instigar a comunidade jurídica para o tema do idoso na sociedade brasileira, que vem ganhando freqüente destaque principalmente após a promulgação do Estatuto do Idoso (Lei 10.741/2003) e também pelas recentes reformas no sistema previdenciário brasileiro.

ABSTRACT
This article examines the issue of self-care, which is widely developed in the work Hermeneutics of the Subject by Michel Foucault (2006). The focus is to elucidate the characteristics of the practice of self-care and what would be the profit for the individual, always related to old age. Understanding the concept of self care, it is possible to relate the idea of claiming rights and privileges of the elderly so that they can fully exercise self-care. Simply put, self care for the elderly, and is only meaningful when it is possible to enjoy legal protection and being guaranteed the material needs, cultural, intellectual and social guidelines. Thus, self care, thought about their genesis as a self reflection of the subject and focused on emancipation, becomes the basis for claiming rights, in the case of this work, the elderly, the public and private spheres. The goal is to instigate the legal community for the theme of the elderly in Brazilian society, which is gaining prominence frequent especially after the promulgation of the Elderly Statute (Law 10.741/2003) and also by recent reforms in the Brazilian social security system.
