PROCESSO JUDICIAL ELETRÔNICO: A EFETIVIDADE DOS ATOS DO PROCESSO ELETRÔNICO À LUZ DOS PRINCÍPIOS CONSTITUCIONAIS
Resumo
O estudo proposto tem como tema o processo judicial eletrônico. O enfoque principal é dado aos atos processuais eletrônicos que estão amparados pela Lei nº 11.419/2006, que o introduziu no ordenamento jurídico brasileiro. Vários são os questionamentos levantados desde a edição dessa lei com a sua aplicabilidade no processo e implicações frente aos princípios constitucionais, o que poderia ser entendido como uma flexibilização desses princípios. Para que se efetive o processo eletrônico é necessária a adoção de certificados digitais para a garantia de integridade, autenticidade e segurança, evitando-se assim as nulidades processuais. Observou-se que o problema da morosidade está na estrutura administrativa do poder Judiciário, não sendo, pois um problema de deficiência de leis. O processo civil brasileiro tem passado por reformas com o objetivo de conferir celeridade e efetividade à prestação jurisdicional. Grande desafio se mostra na transição de um judiciário totalmente burocrático para um judiciário digital, sendo essa uma medida de inclusão social-digital. Esse trabalho está centrado na análise das legislações pertinentes sobre o tema bem como nas implicações geradas pela adoção desses atos eletrônicos no processo. O tema aborda o surgimento de questões relacionadas às citações, notificações, intimações todas via eletrônica e a contagem dos prazos processuais.

ABSTRACT
The theme of the study purposed is the electronic judicial process. The main focus is given to the electronic procedural acts that are based on the Law 11.419/2006, which introduced them in the Brazilian legal system. Some are the questions that emerged since the edition of this law. They’re about its applicability in the process and its implications facing the constitutional principles, what could be comprehended as a flexibility of them. To put the electronic process into effect it’s necessary to adopt digital certificates to guarantee integrity, authenticity and security in order to avoid procedure nullities. It has been seen that the problem of the slowness of the judiciary is not in the law deficiencies, but in its administrative structure. The Brazilian civil process has passed by reformations to give celerity and effectiveness to the jurisdictional activity. A great challenge appears in the transition of a totally bureaucratic judiciary to a digital one, this, a mean of social and digital inclusion. The present work is focused in the pertinent laws analysis about the theme, and also in the implications generated by the adoption of these electronic acts in the process. The theme analyses the arising of questions in relation to electronic citation, notification and intimation and the time-limits count.
